UN, UNRWA, Jordan & Egypt complicit in Gaza civilian casualties

United Nations Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967 - Francesca Albanese - has been roundly condemned by Italy following the release of her Report on October 25: Gaza Genocide: a collective crime.

Italy’s criticism is scathing:

“The report presented today by Special Rapporteur Albanese is entirely devoid of credibility and impartiality. As Italy, we are not surprised.

The content of the report blatantly exceeds the specific mandate of the Special Rapporteur, which does not include investigations into alleged violations committed by other States or entities, nor judgements on cooperation between third countries and the ICC.

Even more concerning is the complete disregard – in particular during the last months – for the code of conduct for Special Rapporteurs, which includes common sense principles such as integrity, impartiality and good faith. These are not optional; they are the foundation of any credible report, of the implementation of the mandate and of the United Nations itself.”

Albanese’s Report Summary claims that:

“The ongoing genocide in Gaza is a collective crime, sustained by the complicity of influential Third States that have enabled longstanding systemic violations of international law by Israel.”

No genocide has occurred in Gaza because:

·       the "Palestinian people" does not constitute a national, ethnical, racial or religious group under Article II of the Convention on the Prevention and Punishment of the Crime of Genocide   

·       There has been no specific intent by Israel to destroy Gaza’s civilian population

Furthermore the United Nations – not Israel – has been complicit in systemically violating international law:

·       Designating Judea and Samaria (West Bank) and Gaza as “the Palestinian territories occupied since 1967” when they are in fact “territories within which the Jewish National Home is to be reconstituted pursuant to articles 6 and 25 of the 1922 League of Nations Mandate for Palestine

·       Passing hundreds of resolutions since 1967 in both the General Assembly and Security Council that breach article 80 of the United Nations own Charter which preserves the rights vested in the Jewish people created by the Mandate for Palestine referred to above.

Albanese omits any mention of the United Nations, UNRWA, Jordan and Egypt’s failure to facilitate the transfer of 1.58 million refugees comprised in Gaza’s population of approximately 2.4 million - housed in 7 UNRWA refugee camps in Gaza - to the comparative safety of 13 UNRWA refugee camps located in Jordan:

·       At any time between 7 October 2023 and 27 October 2023 when Israel’s land invasion of Gaza began and

·       Thereafter when several cease fires were negotiated.

UN Secretary-General Antonio Guterres was warned on 15 February 2024

“Mr Guterres:

You have had four months to move these suffering Gazans to the safety of your own refugee camps outside Gaza – yet you have done nothing – preferring to leave them penned in Gaza as human shields preventing Israel expeditiously hunting down those Gazan monsters responsible for the heinous atrocities committed in Israel on 7 October 2023.”

The United Nations was more interested in playing political games with Gaza’s refugee population than ensuring their survival.

Jordan and Egypt were equally complicit in the deaths and injuries suffered in Gaza by refusing to accept woman, children, and aged and incapacitated refugees.

King Abdullah stated on 17 October 2023:

 “I think I can quite strongly speak on behalf of, not only Jordan as a nation, but of our friends in Egypt — that is a red line.  No, refugees in Jordan, no refugees in Egypt”  

The United Nations, UNRWA, Egypt and Jordan stand condemned for materially contributing to the casualties sustained by Gaza’s refugee population.
